The Driver Oleg Shcherbinsky Case

On the morning of the 7th August 2005, Mercedes-500 with the Governor of the Altai Territory, Mikhail Evdokimov, his wife and guard went on the road Barnaul-Biysk at a speed of about 200 km per hour. When Governor’s Mercedes approached the turn to the town, there was Toyota Marino driven by Oleg Shcherbinsky, a railway employee, who drove to a picnic with his family. As a result of reckless driving by Mikhail Evdokimov’s car driver, Governor’s car hurtled Oleg Shcherbinsky’s car, flew out to the road ditch and then hurtled into a tree. Mikhail Evdokimov, his bodyguard and car driver died in the place of the motorcar accident. However, the crime investigators and judge of the Zonal District Court of Altai Territory accused Oleg Shcherbinsky of the crime. He was sentenced to be confined for a period of 4 years. Anatoly Kucherena acted as Oleg Shcherbinsky’s lawyer at the stage of cassational proceedings. After long debates, the court took the side of the convicted who was acquitted and the first judgement was set aside. Shcherbinsky was released from detention on the same day. As Anatoly Kucherena said at a later date: “Each lawyer seems to live and work for such moments”.
